In recent years, the state's Workers' Compensation Board has become much more aggressive in fining New York businesses. Many studies, including a New York Times article, showed that many New York businesses were paying premiums that were higher than they should have been. The study determined that businesses were paying for other companies that had no workers' compensation coverage. Companies were being "penalized" for doing the right thing.

The state has now begun to use sophisticated computer programs to find gaps in financial records.
